RFTT Shop Terms of Service

Welcome to the Rising From The Township online shop. These Terms of Service govern your access to and use of shop.risingfromthetownship.co.za, including purchases made through the website.

In these terms, “RFTT”, “we”, “us” and “our” refer to Rising From The Township. “You” and “your” refer to the person accessing the website or purchasing products from us.

By placing an order through our website, you confirm that you have read, understood and agreed to these Terms of Service. Nothing in these terms is intended to limit any rights you may have under applicable South African consumer-protection law.

2. Eligibility

You must be at least 18 years old or have the permission and supervision of a parent or legal guardian to place an order through the website.

By placing an order, you confirm that the information you provide is complete, current and accurate and that you are legally authorised to use the selected payment method.

3. Products and Availability

We make reasonable efforts to display product descriptions, images, colours, sizes, prices and availability accurately. However, colours and appearance may vary depending on your device or screen settings.

All products are subject to availability. Adding an item to your cart does not reserve it. We may limit the quantities available for purchase or discontinue a product without prior notice.

Where a product is unavailable after you have placed an order, we will contact you and offer an appropriate replacement, store credit or refund.

4. Prices

Prices are displayed in South African rand (ZAR), unless stated otherwise.

Applicable taxes, delivery fees and other charges will be displayed before you complete checkout. Prices may change without notice, but a price change will not affect an order that we have already accepted.

If a product is listed at an obviously incorrect price because of a genuine error, we may contact you to confirm whether you wish to proceed at the correct price or cancel the affected item and issue a refund.

5. Orders and Contract Formation

Submitting an order is an offer to purchase the products in your cart. An automated order confirmation acknowledges that we have received your order but does not necessarily mean that the order has been accepted.

Your order is accepted when payment has been successfully processed and we confirm that the order is being prepared or dispatched.

We reserve the right to refuse or cancel an order where:

  • A product is unavailable.
  • Payment cannot be authorised or is suspected to be fraudulent.
  • The price or product information contains an obvious error.
  • The order appears to be intended for unauthorised resale.
  • The delivery address is outside an area that we service.
  • Accepting the order would breach applicable law.

If we cancel an order after receiving payment, we will refund the affected amount to the original payment method.

6. Payments

Payments are processed through the payment options displayed during checkout. Payment information may be processed by Shopify and authorised third-party payment providers.

You agree to provide accurate billing and payment details. We do not guarantee that every payment method will always be available.

We will never ask you to send your card PIN, online banking password or one-time password by email or social media.

7. Delivery

Delivery times displayed on the website are estimates and may be affected by courier delays, weather, public holidays, address issues or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address and ensuring that someone is available to receive the parcel where required.

If a parcel cannot be delivered because the address supplied was incorrect or incomplete, you may be responsible for reasonable redelivery costs.

Please inspect your order after delivery and notify us promptly if an item is missing, damaged, defective or incorrect.

8. Returns, Exchanges and Refunds

Returns, exchanges and refunds are handled in accordance with our Refund & Returns Policy, which forms part of these Terms of Service.

Our policies do not exclude or restrict any non-waivable rights available to you under the Consumer Protection Act, the Electronic Communications and Transactions Act or other applicable South African law.

9. Promotions and Discount Codes

Promotional offers and discount codes may be subject to additional conditions, availability periods and usage limits.

Unless otherwise stated:

  • Only one discount code may be used per order.
  • Discounts cannot be exchanged for cash.
  • Discounts cannot be applied retrospectively.
  • Discount codes may not apply to delivery fees, gift cards or specified products.

We may withdraw or correct a promotion where it has been published in error, abused or used fraudulently, subject to applicable law.

10. Gift Cards

Where gift cards are offered, they may only be used through the RFTT online shop and cannot be redeemed for cash except where required by law.

You are responsible for protecting your gift-card details. Please contact us promptly if you believe a gift card has been lost, stolen or used without permission.

11. Website Accounts

If you create a customer account, you are responsible for keeping your login details confidential and for activity conducted through your account.

Please notify us promptly if you believe your account has been accessed without authorisation. We may suspend an account where reasonably necessary to protect customers, prevent fraud or maintain website security.

12. Acceptable Use

You may not use the website:

  • For any unlawful, fraudulent or abusive purpose.
  • To introduce malware, viruses or harmful code.
  • To interfere with the operation or security of the website.
  • To gain unauthorised access to another person’s account or information.
  • To scrape, copy or exploit website content for unauthorised commercial use.
  • To impersonate another person or provide false information.

We may restrict access to the website where reasonably necessary to prevent misuse or protect our customers and systems.

The website and its content—including the RFTT name, logos, branding, photographs, book content, written material, graphics and website design—are owned by or licensed to Rising From The Township and are protected by applicable intellectual-property laws.

You may use the website for personal, non-commercial shopping purposes. You may not reproduce, distribute, modify, publish, sell or commercially exploit our content without prior written permission.

Purchasing a book, product or digital item does not transfer any intellectual-property rights to you.

14. Reviews and User-Submitted Content

If you submit a review, photograph, testimonial or other content, you confirm that:

  • The content is truthful and based on your genuine experience.
  • You have the right to submit it.
  • It does not violate another person’s rights.
  • It is not unlawful, defamatory, abusive or misleading.

You grant RFTT a non-exclusive, royalty-free licence to display and use submitted content for operating and promoting the store. We may remove content that breaches these terms or applicable law.

15. Third-Party Services and Links

Our website may use or link to third-party services, including Shopify, payment providers, courier companies and social-media platforms.

Third-party services operate under their own terms and privacy policies. We are not responsible for external websites or services that we do not control, although this does not limit any responsibility that cannot lawfully be excluded.

We process personal information needed to operate the store, fulfil orders, communicate with customers, prevent fraud and comply with legal obligations.

17. Website Availability

We aim to keep the website available and secure, but we do not guarantee uninterrupted or error-free access. The website may occasionally be unavailable for maintenance, upgrades, technical issues or circumstances outside our control.

18. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, RFTT will not be liable for indirect, incidental or consequential losses arising from your use of the website or purchase of products.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability arising from gross negligence, fraudulent conduct or any rights and remedies that cannot be waived under South African consumer law.

Product information on the website is provided for general informational purposes. It should not be treated as professional, legal, financial or business advice.

19. Events Outside Our Control

We will not be responsible for a delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, strikes, civil unrest, network failures, load shedding, supplier interruptions or courier disruptions.

We will take reasonable steps to minimise the effect of such events and communicate material delays where practical.

20. Changes to These Terms

We may update these Terms of Service to reflect changes to our products, website, operations or legal obligations.

The latest version will be published on this page with an updated revision date. Changes will apply prospectively and will not unfairly alter an order already accepted.

21. Severability

If any provision of these terms is found to be unlawful or unenforceable, that provision will be applied to the greatest extent permitted by law. The remaining provisions will continue to apply.

22. Governing Law and Disputes

These Terms of Service are governed by the laws of the Republic of South Africa.

If a dispute arises, please contact us first so that we can attempt to resolve it directly. Nothing in these terms prevents you from approaching the National Consumer Commission, a consumer court, the Information Regulator, an ombud with jurisdiction or any other competent authority or court.
